PLEASE, READ THESE TERMS CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. BY USING OUR SERVICES, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND ACCEPT TO BE BOUND BY ITS TERMS AND ALL FUTURE MODIFICATIONS TO THESE TERMS, AS WELL AS TO THE COLLECTION AND USE OF YOUR INFORMATION AS SET OUT IN OUR PRIVACY POLICY. WHERE A USER BREACHES ANY OF THESE TERMS, WE RESERVE THE RIGHT TO TERMINATE THE USER’S ADMISSION TO USE OUR SERVICES.
Ondigo Technologies, as registered under the laws of the Federal Republic of Nigeria, is a leading innovator in the provision of efficient NFC (Near Field Communication) smart card technology designed to facilitate integrated payment systems for transportation services across Nigeria. We aim to streamline the payment process for commuters and transport service providers, promoting a seamless, secure, and efficient cashless transaction experience.
Our solution enables fast, reliable, and contactless payments at bus terminals, transit stations, and other transportation hubs, thereby reducing the reliance on cash, improving financial transparency, and enhancing the overall user experience for both commuters and transportation providers. We are driven by a vision to revolutionize the transportation industry in Nigeria by providing an efficient and reliable payment infrastructure designed with security, scalability, and ease of use at the forefront.
You must be at least 18 years old to register and use Ondigo Technologies independently and, as well, agree to be bound by our terms and conditions. You are solely responsible for ensuring that your use of our Services is in compliance with all the laws of the applicable jurisdiction. If you are accepting these Terms on behalf of a company, business, or organization, you represent and warrant that you are authorized to do so. We reserve the right to withdraw or modify the Services we provide with or without prior notice.
Minors (individuals between 8-17 years of age) are permitted to use our smart card. However, the minor’s smart card must be linked to the account of a parent, legal guardian, or an authorized adult (referred to as the Responsible Account Holder).
The Responsible Account Holder must provide consent and agree to manage the minor’s use of the card. The Responsible Account Holder is fully liable for all transactions, fees, and activities conducted using the minor’s card, and must ensure compliance with these Terms. Ondigo Technologies disclaims any liability arising from unauthorized use of the smart card by minors.
Ondigo Technologies may require you to create a user account or log in with your information to use our Services. This may involve providing some information such as name, email address, password, date of birth, country, telephone number, and financial information to create a user account with us. You must provide accurate and complete information for this purpose.
By using our Services, you authorize us to collect, store, retain, and use all information in accordance with our privacy policy. You will not use the name of another person as your username with the intention of impersonating that person. You will not use another person’s user account or identification details without permission.
All user identification details, passwords and other data provided as part of our security procedures should be treated as confidential and should not be disclosed to any third party. You will be solely responsible for any activity that that occurs under your user account due to the misuse of your identification data or passwords. If you become aware of or suspect a breach of the security of our Services, you agree to notify us immediately.
All payments are securely processed through an authorized third-party payment processor. Ondigo Technologies only act as a facilitator for payments and is not a financial institution or bank. All payments must be made in Nigerian Naira using an acceptable payment method.
You authorize Ondigo Technologies and its payment processors to charge applicable fees associated with the use of our Services. If a payment fails due to insufficient funds, incorrect payment details, or any other reason whatsoever, the user will be notified of such reason.
We reserve the right to set and review the applicable fees. You will be notified of significant reviews, and continued use of our Services after the effective date of such review shall constitute acceptance of the changes.
We respect your privacy and are committed to safeguarding your right to privacy and your personal data. With respect to all personal information provided to Ondigo Technologies, such personal information, at all times, are treated in compliance with the Nigeria Data Protection Act, 2023 and all applicable data protection regulations in force. Ondigo Technologies maintains a Privacy Notice which provides an overview of the personal information we collect about you or that you provide to us.
You acknowledge and accept that Ondigo Technologies own all intellectual property rights in relation to its Services including, but not limited to, brand names, logos, texts, images, design, software, graphics, animations, music, videos, and other materials and information (collectively referred to as “Content”) presented to you through the use of our Services. You do not acquire ownership rights to our content by reason of your access to our Services.
We, however, grant you a non-assignable, non-exclusive, and revocable license to use the software and hardware provided as part of our services in the manner stipulated in these Terms. This license captures, as well, all updates, upgrades, and replacements which may be made at any point for your use in relation to our Services.
A user may, for their personal non-commercial use only, view, download, or print any page or section of the Services for personal reference. Subject to these Terms, no Content may be copied, reproduced, republished, transferred, modified, transmitted, displayed, sold, distributed, or licensed, by any means, or otherwise exploited without prior written permission by us.
Our Services are provided “as is” without warranties of any kind. Hence, we do not guarantee that our Services will be error-free, uninterrupted, or free from unauthorized access. Ondigo Technologies, its staff, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, but not limited to, losses arising from the use or inability to use our Services, unauthorized access to your data, actions taken based on information provided through our platform, and any other issue whatsoever related to Ondigo Technologies.
We are not liable for interruptions, delays, errors or any other issue whatsoever caused by third-party service providers such as payment processors and transport service providers. You acknowledge and agree that these entities operate independently of Ondigo Technologies.
Our liability is limited to the maximum extent permitted by law. In no circumstance shall the total liability of Ondigo Technologies for claims arising from its Services exceed the total amount paid by the user for the specific service giving rise to the claim within the period of six months preceding the event that led to the claim.
By using our Services, you agree to indemnify, defend, and hold harmless Ondigo Technologies, its staff, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your breach of these Terms, misuse of our Services, fraud, negligence, intentional misconduct, and third-party claims resulting from your actions or omissions. You must promptly notify Ondigo Technologies of any claim, demand, or legal action subject to indemnification. Failure to provide timely notice shall limit the ability of Ondigo Technologies to defend itself effectively.
You may cease using our Services by disabling your user account. We reserve the right to suspend or terminate your access to our Services with or without prior notice for violation of any of these Terms, fraudulent practices, illegal activities, or request from appropriate legal authorities. Ondigo Technologies is not liable for any losses, damages, or inconveniences arising from the suspension or termination of your account in accordance with these Terms, and we reserve the sole discretion to reinstate your account following suspension or termination.
We reserve the right to revise, amend, or update these Terms at any time with or without prior notice. While we will endeavor to notify you of significant modifications, you are encouraged to regularly refer to our Terms and familiarize yourself with effected modifications.
Such revisions, amendments, or updates shall be binding on all users with immediate effect, unless otherwise stated. Your continued use of our services will be regarded as an acceptance to be bound by such modifications.
Users may provide feedback or seek clarification regarding modifications by contacting us. While we value user input, the decision to modify the Terms remains a sole discretion of Ondigo Technologies.
